Martelli Online Store Terms and Conditions
These terms and conditions govern your use of the Martelli Online Store. By placing an order through the Martelli Online Store, you express your understanding and agreement that you are bound by these Terms. These Terms apply only to orders you place using the Martelli Online Store.
Order Validation and Acceptance
When you place an order through the Martelli Online Store, we may verify your method of payment and shipping address, before processing your order. Your placement of an order via the Martelli Online Store is an offer to purchase our products or services. Martelli Online may accept your order by processing your payment and shipping the product or documentation of service, or may for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by Martelli Online Store until the product has been shipped. If we decline to accept your order, we will attempt to notify you using the email address and/or phone number you have provided with your order.
Quantity and Duration Limitations
Martelli Online may limit or cancel quantities available for purchase on any order on any basis, or alter the availability or duration of any special offers at any time. Martelli Online Store may limit or prohibit sales to resellers or dealers via the Martelli Online Store.
Electronic Communication
When you place an order through the Martelli Online Store, you are required to provide a valid email address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of back-ordered products, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that Martelli Online Store will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid email address.
Product Display/Colors
Martelli Online attempts to display as accurately as possible the colors of the products shown on the site. However because the colors you see will depend on many factors, including your monitor or printer, Martelli Online cannot guarantee that the color you see matches the product color.
Pricing and Product Information
Martelli Online Store makes every effort to provide current and accurate information relating to its products, services, and prices, but does not guarantee the currency or accuracy of any such information. Information relating to Martelli Online Store’s products and services is subject to change without notice. Prices are subject to change at any time prior to acceptance of your order. In the event we discover an error in the description, pricing, or availability of a product or service that affects your outstanding order, we will notify you of the error, and you may choose to accept the corrected version, or cancel the order. If you choose to cancel the order, and your credit card has already been charged for a purchase, Martelli Online will issue a credit to your credit card in the amount of the charge. Prices that appear on the site are the manufacturer’s suggested retail price (MSRP), unless otherwise indicated. These prices may differ from those at other retail outlets, including those of our wholesale customers (dealers and distributors).
Security and Privacy
Martelli Online Store takes seriously your personal security and privacy, and follows the industry standard, a Secure Socket Layer (SSL) protocol, for the transfer of personal data and purchase information over the Internet. When placing an order online, a “key-lock icon will appear in the bottom right of your browser window. This icon is your confirmation that SSL has been activated for the transfer of your personal information. A second indication of SSL activation is that the displayed URL will begin with "https://" instead of ‘http://”.
Payment and Shipment
You may pay for your order with one of the following major credit cards, issued in the United States of America: Visa®, MasterCard®, DiscoverCard®, and American Express®. Orders placed before 2:00 p.m. Central, Monday through Friday, will generally be processed, billed, and shipped the same business day. Orders placed after 2:00 p.m. Central, Monday through Friday, or on weekends, will generally be processed and billed that day, and will generally be shipped the following business day. If Martelli Online Store declines to accept your order, no payment will be processed. If your order is declined, but your card is charged in error, Martelli Online will issue a refund. In the event your shipment will be delayed more than thirty (30) days after the date of your order, we will notify you at the email provided, and you may elect to cancel the order. If you elect to cancel the order, Martelli Online will issue a refund.
Shipping and Handling
Shipping and handling charges will be added to the cost of your order. Generally, all orders are shipped within 48 hours of receipt, Monday through Friday. Unfortunately, we are unable to ship to PO, APO, or FPO boxes. Orders received by 2:00 p.m. Central will generally be shipped the same or next day business day. In order to receive a product on the next business day, you should place your order before 2:00 p.m. Central, and choose the appropriate option when you select your shipping method. Orders are not shipped or delivered on weekends or national holidays.
Sales Tax
Martelli Online collects and remits sales taxes as required by law on purchases made via the online store. If you have tax-exempt status, you must provide a valid tax exemption number evidencing your status at the time of purchase. Martelli Online Store will not refund tax amounts collected in the event a valid number is not provided. If you provide a number that is not accepted for any reason by any governmental or regulatory authority, and Martelli Online is required to pay tax on your purchase, the customer will reimburse Martelli Online Store for the amount of such tax, and any expenses incurred in connection with the payment and collection of such tax.
Warranties
The only warranties Martelli Online provides with respect to any product or service purchased through the Martelli Online Store are those warranties, if any, set forth in the written documentation accompanying such product or service.
